On the subject of the crime of aggression which recently the circumstances of the prosecution have been provided in the international criminal court, exercising (practicing) the mentioned principle has been faced obstacles and limits specially in the national (domestic) proceedings. Some of these limits are because of the quiddity of the crime aggression and its perpetrators that in spite of being committed by a senior member of a government, necessarily it follows the act of a government and it is committed against another government. Some other obstacles are because of the provisions of exercising the jurisdiction to the crime of aggression which in addition to ratifying the amendments to the Rome statute held in Kampala (2010), it includes cases such as the absence of issuing declaration excluding the jurisdiction of the international criminal court and the interferences of The United Nations Security Council. While studying the principle of the complementarity of the international criminal court, this paper carefully examines the obstacles and limits of the national trials of the States Parties to the Rome Statute in exercising the crime of aggression.  }, keywords = {Keywords: The International Criminal Court (ICC),Complementarity,Aggression,The Kampala conference,The United Nations Security Council}, title_fa = {تکمیلی بودن صلاحیت دیوان بین‌المللی کیفری و جنایت تجاوز}, abstract_fa = {بر اساس اصل «تکمیلی بودنِ» صلاحیت دیوان بین‌المللی کیفری، دادگاه‌های داخلی دولت‌های طرف اساسنامه در رسیدگی به جرایم تحت صلاحیت دیوان اولویت دارند. در خصوص جرم تجاوز که اخیراً شرایط رسیدگی به آن در دیوان مهیا گردیده است، اِعمال اصل مزبور با موانع و محدودیت‌هایی به ویژه در رسیدگی‌های ملی مواجه می‌شود. برخی از این محدودیت‌ها به سبب ماهیت جرم تجاوز و مرتکبان آن است که به رغم ارتکاب از سوی یک مقام رده‌بالای دولت، لزوماً عمل یک دولت را به همراه دارد و علیه یک دولت دیگر ارتکاب می‌یابد. برخی موانع دیگر نیز به واسطۀ شرایط اعمال صلاحیت نسبت به جرم تجاوز است که علاوه بر تصویب اصلاحیه‌های کنفرانس کامپالا (2010)، مواردی از جمله عدم صدور اعلامیۀ مستثناکنندۀ صلاحیت دیوان و دخالت‌های شورای امنیت سازمان ملل را نیز شامل می‌گردد. این نوشتار قصد دارد ضمن بررسی اصل «تکمیلی بودن» صلاحیت دیوان، موانع و محدودیت‌های دادگاه‌های ملیِ دولت‌های طرف اساسنامه و دیوان بین‌المللی کیفری را در اعمال صلاحیت نسبت به جرم تجاوز مورد بررسی قرار دهد.}, keywords_fa = {دیوان بین‌المللی کیفری,تکمیلی بودن,تجاوز,کنفرانس کامپالا,شورای امنیت}, url = {https://cld.razavi.ac.ir/article_493.html}, eprint = {https://cld.razavi.ac.ir/article_493_9aa2fd83737d2e4fb111ff9f5f7a8614.pdf} }
