The use of these weapons is considered a serious threat to human health and the peace and security of the international community due to their unique characteristics. The danger of such weapons is greater than the danger of nuclear and chemical weapons, because they are capable of destroying tens of millions of people in a short period of time, and their consequences could be passed-on to the next generations. The results of this study, organized by a descriptive-analytical method, show that although biological weapons did not exist in their present modern form at the time of the emergence of Islam, but the accepted theoretical basis for prohibiting the use and punishment of using such weapons is based on the relatively similar rules in Islamic Sharia (Arabic: شریعة) and the international criminal system. Therefore, Islamic teachings and sharia law can also be used to prohibit the use of such weapons as may be cited by various international documents, in which such rules and regulations that govern the standards of human rights and international humanitarian law and conform to (in accordance with) the rational Sharia and the interests of human society. }, keywords = {War crimes,Crimes against humanity,International Criminal Law,Islamic Law,Biological weapons}, title_fa = {ممنوعیت کاربرد سلاح‌های بیولوژیک از منظر حقوق بین‌الملل کیفری و اسلام}, abstract_fa = {چنانچه از عوامل بیولوژیک و سمّی زیانبار، به عنوان سلاح در درگیری‌های مسلحانه و عملیات‌های تروریستی استفاده شود، آن عامل در زمره سلاح‌های بیولوژیک قرار می‌گیرد. سلاح‌های بیولوژیک که سابقه‌ای تاریخی جهت به کارگیری در اقدامات تروریستی و منازعات نظامی دارند، امروزه به طور خاصی مورد توجه کشورهای پیشرفته قرار گرفته‌اند. کاربرد این سلاح‌ها با توجه به ویژگی‌های منحصر به فردی که دارند، تهدیدی جدی برای سلامت انسان‌ها و صلح و امنیت جامعه جهانی محسوب می‌گردد. خطر این گونه سلاح‌ها بیشتر از خطر سلاح‌های هسته‌ای و شیمیایی است؛ زیرا قادرند در مدت‌زمانی کوتاه، موجب نابودی ده‌ها میلیون انسان شوند و عوارض ناشی از آن‌ها می‌تواند به نسل‌های بعدی نیز منتقل گردد. نتایج این بررسی که با شیوه توصیفی ـ تحلیلی سامان یافته است، نشان می‌دهد که هرچند سلاح‌های بیولوژیک در زمان ظهور اسلام به شکل امروزی وجود نداشته‌اند، ولی مبنای نظری مورد قبول در منع به کارگیری و مجازات استفاده از این گونه سلاح‌ها، مبتنی بر قواعد نسبتاً مشابه در شریعت اسلامی و نظام بین‌المللی کیفری است. بنابراین برای منع به کارگیری این گونه سلاح‌ها همچنان که ممکن است به اسناد مختلف بین‌المللی استناد کرد، می‌توان به آموزه‌های اسلامی و احکام شریعت نیز توسل جست؛ احکام و قواعدی که ناظر بر موازین حقوق بشر و حقوق بشردوستانه و منطبق بر شریعت عقلانی و مصالح جامعه بشری است.}, keywords_fa = {جنایت جنگی,جنایت علیه بشریت,حقوق بین‌المللی کیفری,حقوق اسلامی,سلاح‌های بیولوژیک}, url = {https://cld.razavi.ac.ir/article_1691.html}, eprint = {https://cld.razavi.ac.ir/article_1691_b8cf1689c22b0b38a27f05349dfeec25.pdf} }
