The prosecutor’s duty is to reveal the exculpatory evidence in his hand to the defendant. For the first time, the simple pattern of the Supreme Court of the United States indicating the recognition of this right and its importance to some extent that the non-disclosure of the exculpatory evidence leads to exonerate or tend to exonerate the defendant of guilt (the non-disclosure of the exculpatory evidence goes towards negating a defendant’s guilt). But at international level, the collection and disclosure of the exculpatory evidence in the International Criminal Tribunal for the former Yugoslavia (ICTY) is permitted to a certain degree that it does not establish obstacles in the collaboration of the data sources of this evidence with the prosecutor. From this view, the secrecy of the sources of the exculpatory evidence is located at the first stage and the accused’s rights at second stage. But this condition has been promoted in the International Criminal Court (ICC or ICCT) to a great extent. The prosecutor is required to disclose the exculpatory evidences to the accused. Even though the other contradictory obligations are accepted in this ground, according to it, the secondary duties do not reduce the prosecutor’s responsibility for the disclosure of the exculpatory evidence.  }, keywords = {Keywords: The Supreme Court of the United States,The International Criminal Tribunal for the former Yugoslavia (ICTY),The International Criminal Court (ICC),The right of the defendant’s awareness,The exculpatory evidence,Fair trial}, title_fa = {حق آگاهی متهم از دلایل تبرئه‌کنندۀ در اختیار دادستان (از الگوی سادۀ دیوان عالی ایالات متحده تا تکامل مقید در دادگاه‌های کیفری بین‌المللی}, abstract_fa = {حق آگاهی متهم از دلایل تبرئه‌کنندۀ در اختیار دادستان از بایسته‌های دادرسی عادلانه است. بر این اساس، دادستان قبل از شروع محاکمه، مکلف به افشای دلایل تبرئه‌کنندۀ در اختیار خویش به متهم است. برای اولین بار، الگوی دیوان عالی ایالات متحده حاکی از شناسایی این حق و اهمیت آن است تا حدی که عدم افشای دلایل تبرئه‌کننده به متهم از سوی دادستان، منجر به صدور حکم تبرئۀ وی می‌شود. اما در سطح بین‌المللی، جمع‌آوری و افشای این دلایل در دادگاه کیفری بین‌المللی یوگسلاوی سابق تا حدی مجاز است که مانع از همکاری منابع اطلاعاتی این دلایل با دادستان نشود. از این منظر، حفظ محرمانگی منابع دلایل در مرحلۀ اول، و حق آگاهی متهم از این دلایل در مرتبۀ دوم قرار می‌گیرند. لیکن این وضعیت در مقررات دیوان کیفری بین‌المللی تا حد زیادی ارتقا یافته است. دادستان ملزم به افشای دلایل تبرئه‌کننده به متهم است، ولو اینکه تعهداتِ متناقض دیگری را در این زمینه پذیرفته باشد. بر این اساس، تعهدات ثانوی چیزی از مسئولیت دادستان در افشای دلایل تبرئه‌کننده به متهم نمی‌کاهد.}, keywords_fa = {دیوان عالی ایالات متحده,دادگاه کیفری بین‌المللی یوگسلاوی سابق,دیوان کیفری بین‌المللی,حق آگاهی متهم,دلایل تبرئه‌کننده,دادرسی عادلانه}, url = {https://cld.razavi.ac.ir/article_623.html}, eprint = {https://cld.razavi.ac.ir/article_623_66340446a1a7715241d18479b5966663.pdf} }
