Therefore, considering those conditions, infertile spouses substitute mother, and third parties can use such a manner as the subject of their contract or promise and subsequently, contracts and promises be formed or made among infertile spouses, substitute mother, spouses and other third parties who are related to this subject somehow. <br />     In this article it is tried, on the basis of doctrines and sources of Imamiyyah (Shiism) jurisprudence and the law of Iran, to examine the nature of a contract for utilization from a substitute womb and to make it clear that what kind of contracts would be more suitable if individuals desire to use the method of substitution in pregnancy (fertility). <br />  مبانی فقهی و حقوقی، استفاده از رحم جایگزین را در مواردی با رعایت شرایطی جایز شمرده است؛ بنابراین، زوجهای نابارور و مادر جانشین می‌توانند با رعایت آن شرایط، چنین شیوه‌ای را موضوع قرارداد یا تعهّد قرار دهند و در نتیجة آن تعهّدات و قراردادهایی بین زوجهای نابارور، مادر جانشین، زوجها و اشخاص ثالث دیگری که به گونه‌ای با این موضوع مرتبط می‌باشند، ایجاد شود.<br />       در این نوشتار، بر پایة مبانی و منابع فقه امامیه و حقوق ایران، ماهیت قرارداد استفاده از رحم جایگزین بررسی می‌شود و تبیین می‌گردد که در بارداری، چه نوع قراردادی برای شیوة جانشینی مناسب‌تر است.<br />   https://cld.razavi.ac.ir/article_1346_53d8a96ec9aa4f4461aca19460e347c1.pdf
