Legal System of the Caspian Sea under the Treaties of 1921 and 1940 between Iran and Russia

Abstract

A legal system from which the Caspian Sea and its sources should follow, is a matter of substantial importance from economical, political, geopolitical and energy security point of view. After Russia liquidation and the emergence of new countries, the subject has underwent further complications and up to now two kinds of legal systems namely, “joint sovereignty or condominium” and “partition and delimitation” have been proposed by coastal states of the Caspian Sea.
    This article, on the basis of international case law, deals with the recognition of the necessary terms and requirements for the legal system of “condominium” in international law and then examines the possibility of conformity of such system with the legal state of the Caspian Sea.
