جرایم وضعیتی کودکان و نوجوانان؛ سودمند یا زیان‏‌بار؟ (با نگاهی به نظام‌عدالت آمریکا و انگلستان)

چکیده

جرم وضعیتی یا جرم خاص کودک و نوجوان رفتاری است که مطابق معیار متوسط جهانی انجام آن توسط بزرگسال قانونی است و مهم‌ترین مصادیق آن شامل مدرسه و منزل‌گریزی، نقض مقررات منع آمدورفت، اصلاح‌ناپذیری و استعمال مشروب و دخانیات است، لکن گسترۀ آن‌ با شرایط سیاسی و اجتماعی جوامع تنیده است. این پژوهش به روش تطبیقی با بررسی نمونه‌هایی از دو رویکرد  قدیمی رفاه و مداخلۀ عدالت کیفری یعنی نظام‌های عدالت نوجوانان آمریکا و انگلستان و همچنین تحلیل ق.م.ا 92، قانون حمایت از اطفال و نوجوانان 99 و مقررات پراکندۀ رفاهی و رویۀ قضایی در ایران به ماهیت این کژرفتاری‌ها والگوهای پاسخ‌دهی به آن‌ها پرداخته است. مطابق یافته‌های پژوهش، رویکرد رفاه‌محور با بهره‌مندی از دانش بین‌رشته‌ای، مشارکت اجتماعی و قابلیت تطبیق با وضعیت‌های متنوع درجرم‌زدایی، پیشگیری از تکرار این کژرفتاری‌ها، بزهکاری آتی ، کاهش هزینه‌ها و حفظ انسجام خانواده مؤثر است. در حقوق ایران برخی از این وضعیت‌ها به‌موجب مقررات پراکنده و قانون حمایت از اطفال و نوجوانان مشمول رویکرد درمانی هستند و برخی نیز واجد وصف مجرمانه‌اند که الزام قانونی مواد 3 و 5 این قانون ناظر به اعمال رویکرد درمانی در کنار ظرفیت‌های ق.م.ا می‌تواند در شکل‌گیری و توسعۀ رویکرد درمانی مؤثر واقع‌شود. در این راستا بایسته است نهاد قضایی با تمسک به بخشنامه‌های رویه‌ساز در کنار آموزش دادرسان، زمینۀ اجرای مادۀ 6 قانون فوق و آیین‌نامۀ اجرایی آن را فراهم آورد. این امر نافی تکلیف اصلاح مادۀ 91 با لحاظ رویکردهای فقهی و حقوقی توسط قانون‌گذار نیست.

Status offenses are considered legal for adults based on a global criterion. Although the most important examples of status are truancy, running away from home, breaking curfew, incorrigibility and  the consumption of alcoholic beverages and drugs, the scope of criminalization might be tied with the cultural and societal spheres of societies. Applying comparative research method, this research describes advanced juvenile justice models of the US and England based on famous approaches of welfare and justice to find the consequences of de/criminalization and analyses the Islamic Penal Code of 1392, Juvenile Protection Act of 1399 and disperse welfare regulations and judicial practices in Iran to identify the nature of these deviances and patterns to respond them. Based on the research results, welfare-based approach with its capacity to suit with various circumstances may be effective in decriminalization, prevention of recidivism and future delinquencies, decrease in the dispenses and sustain of solidarity of the family. In the Iranian law some of these situations have been included in treatment approach and some have criminal description according to disperse provisions and the Juvenile Protection Act. The legislative requirement of articles 3 and 5 of the later Act on treatment approach, alongside with capacities of the Islamic Penal Code can be effective in formation and development of treatment approach. Accordingly, the legislative body should adduce to practice maker bylaws, alongside training judges to provide the context of executing article 6 of the Act and its executive Bylaw. Such act would not negate the duty of the legislature to amend Article 91 with consideration of Islamic jurisprudence and legal aspects.
