This research, with an ontological approach, seeks to discover and explain the nature and rationale of different types of criminal decrees in light of the main categories of Sharia rulings, presenting the jurisprudential results derived from this essential understanding. The research method is theoretical and fundamental, based on the examination and analysis of jurisprudential texts. Findings indicate that criminal decrees possess a multifaceted nature comprising authoritative (Mawlawi), transactional, real, and primary dimensions. However, they incorporate a combination of original establishment (Ta'sis) and divine confirmation (Imdā') by the Lawgiver. Considering the purposes behind the legislation of criminal decrees, they contain fixed elements but are also variable in execution and procedure, particularly in light of necessary expediencies (Masaleh). This analysis, through its innovative research and analytical method, presents a layered and dynamic picture of the nature of criminal decrees and carries significant jurisprudential consequences. These include the unacceptability of existing jurisprudential perceptions regarding the nature of criminal decrees, facilitating criminal theorizing based on Sharia rulings, accepting the influence of expediencies and rational developments in the process of inferring criminal decrees and formulating criminal laws, and strengthening the instrumental conception in some of its elements, such as the procedural nature of the method and means of punishment.
