آیندۀ نهادینه‌سازی فرایندهای ترمیمی ناظر بر بزهکاری اطفال و نوجوانان در ایران؛ مطالعۀ موردی: لایحۀ پلیس ویژۀ اطفال و نوجوانان

چکیده

هدف اصلی پژوهش، تحلیل رویکرد ترمیمی قانون‌گذار در لایحۀ پلیس ویژۀ اطفال و نوجوانان از منظر سیاست‌های عدالت ترمیمی است تا از این رهگذر، دانش مفیدی برای تقویت کارآمدی فرایندهای ترمیمی در جریان تصویب قانونی این لایحه در مجلس شورای اسلامی، به دست آید. روش‌تحقیق از نوع تحلیلی - توصیفی است که با مطالعۀ موردی لایحۀ پلیس ویژۀ اطفال و نوجوانان مصوب 1400و نیز تطبیق آن با قوانین و سیاست‌های عدالت ترمیمی اتخاذشده توسط کشورهای پیشرو و باسابقه در نهادینه‌سازی فرایندهای ‌ترمیمی، به تحلیل مهم‌ترین سیاست‌های ترمیمی اتخاذشدۀ لایحه پرداخته است. یافته‌های پژوهش حاضر با مطالعۀ موردی لایحۀ مزبور نشان می‌دهد که ابهام در اتخاذ سیاست تعدد فرایندهای ترمیمی ناظر بر بزهکاری اطفال و نوجوانان توسط قانون‌گذار به‌دنبالِ توسعۀ مفهومی و تخصیص‌ فرایند میانجی‌گری برای حمایت بیشتر از اطفال و نوجوانان رقم خورده است. همچنین به سبب تغییر الگوی تطبیقی از گزینش پلیس به‌عنوان برگزارکنندۀ عمدۀ فرایندها به محدود نمودن نقش آن در ارجاع‌دهندگی، رویکرد قانون‌گذار را به‌عنوان ابتکاری نو پذیرفته، هرچند که بر عدم پیش‌بینی سازوکارهای مقابله با پیامدهای ناگوار در برگزاری فرایندهای ترمیمی تحت رهبری پلیس تأکید داشته است. همچنین در وارسی سیاست‌های حاکم بر نظام ارجاع، چالش‌هایی نظیر تضاد رویکرد قانون‌گذار در پذیرش اصل رضایت طرفین، عدم وجود نظام نظارتی بر میزان ارجاع مقامات قضایی و نیز امکان به وجود آمدن چالش‌های اجرایی در مرحلۀ تحقیقات مقدماتی را شناسایی نموده است. در نهایت نیز سیاست‌های ترمیمی پیشگامانۀ ایران ضمن در نظر گرفتن چالش‌های آتی آن برجسته شده‌اند. نتایج نشان می‌دهد که برای بهره‌برداری کامل و اثربخش از عدالت ترمیمی، لایحه نیازمند بازنگری‌های اساسی می‌باشد، از جمله تعیین معیارهای روشن برای انتخاب نوع فرایندها، آموزش تخصصی برگزارکنندگان و مقامات ارجاع‌دهنده، تقویت فرهنگ ترمیمی در سازمان‌های کیفری، یکپارچه‌سازی رویکرد قانون‌گذار در پذیرش اصل رضایت طرفین در امر ارجاع، تضمین نظارت بر نظام حاکم بر ارجاع و اتخاذ سازوکارهای متناسب در خصوص جرائم جدی و خشن.

Objective: The Research goal is to analyze of legislator’s restorative approach in the Special Police for Juveniles Bill from perspective of Restorative Justice (RJ) policies, aiming to derive insights that enhance the effectiveness of restorative processes during the bill’s approval in the Islamic Parliament of IRI. Method: The research employs descriptive-analytical methodology, case studying the Bill and comparing it with RJ policies implemented by leading countries. This approach aims to identify the most prominent restorative policies implemented by the bill. Results: This study finds ambiguity in applying multiple restorative methods aims to specialization mediation for supporting youth. Given the changing role of police in the adaptive model from facilitator to referrer, the bill's assignment of major agency to police in facilitating restorative processes demonstrates the legislator's thoughtful initiative, although it highlights the lack of mechanisms to respond to negative outcomes in police-led restorative processes. Referral challenges include inconsistent acceptance of consent by the parties, lack of oversight of judicial referrals, and potential issues during preliminary investigations. Ultimately, the pioneering distinctions of the Iranian restorative policymaking are highlighted while taking future challenges into account. Conclusions: The results indicate that to effectively implement RJ, the bill requires fundamental revisions, including clear criteria for the selection of process, specialized training for facilitators and referring authorities, strengthening restorative culture in criminal organizations, unifying the legislator’s approach to party consent in referrals, ensuring oversight of referral system, and adopting appropriate mechanisms for violent crimes.
