Biological weapons, which have a historical history of use in terrorist acts and military conflicts have been especially noticed by developed countries today. The use of these weapons is considered a serious threat to human health and the peace and security of the international community due to their unique characteristics. The danger of such weapons is greater than the danger of nuclear and chemical weapons, because they are capable of destroying tens of millions of people in a short period of time, and their consequences could be passed-on to the next generations. The results of this study, organized by a descriptive-analytical method, show that although biological weapons did not exist in their present modern form at the time of the emergence of Islam, but the accepted theoretical basis for prohibiting the use and punishment of using such weapons is based on the relatively similar rules in Islamic Sharia (Arabic: شریعة) and the international criminal system. Therefore, Islamic teachings and sharia law can also be used to prohibit the use of such weapons as may be cited by various international documents, in which such rules and regulations that govern the standards of human rights and international humanitarian law and conform to (in accordance with) the rational Sharia and the interests of human society.
